Child pornography involves creating, publishing, or distributing material depicting minors in real or simulated sexual situations, including sexting a naked picture of a minor in California.
It is a wobbler offense, meaning it can be charged as a misdemeanor (up to 1 year in county jail and a $2,000 fine) or a felony (16 months to 8 years in state prison and fines up to $100,000), depending on the case.
