Rape

Rape is nonconsensual intercourse achieved through threats, force, fraud, or with an unconscious victim.

It is a felony, punishable by:

• 3, 6, or 8 years in state prison.

• If the victim is a minor: 7 to 13 years in state prison.

• May count as a strike on the defendant’s record.
