Statutory Rape

Statutory rape occurs when an adult engages in sexual activity with an unmarried partner under 18.

This is a wobbler offense, meaning it can be charged as:

• Misdemeanor: Up to 1 year in county jail, $1,000 fine, and summary probation.

• Felony: Up to 3 or 4 years in county jail, $10,000 fine, and summary or formal probation.
